JDW PHOTOGRAPHY CLIENT GALLERY TERMS OF SERVICE

BY ACCESSING AND USING THIS CLIENT GALLERY, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THIS SERVICE.

1. GALLERY ACCESS

1.1 JDW Photography provides this password-protected online gallery service ("Gallery") for the convenience of our clients.

1.2 The Gallery and its contents are intended solely for the personal use of the client and individuals authorized by the client.

1.3 Sharing access credentials (passwords, links) with unauthorized third parties is strictly prohibited.

1.4 JDW Photography reserves the right to revoke Gallery access at any time.

2. IMAGE USAGE

2.1 All images in the Gallery are the copyrighted property of JDW Photography.

2.2 Images are provided for viewing, selection, and personal use as defined by your photography service agreement.

2.3 Unless otherwise specified in your photography agreement, you may not:

  • Reproduce, distribute, or publicly display the images

  • Edit, alter, crop, or modify the images in any way

  • Remove watermarks or other copyright information

  • Use the images for commercial purposes

2.4 Social media use of watermarked preview images is prohibited unless explicitly permitted.

3. IMAGE SELECTIONS

3.1 You are responsible for making your image selections within the timeframe specified (typically 14 days from gallery delivery).

3.2 JDW Photography cannot guarantee the availability of images beyond the specified selection period.

3.3 Once selections are submitted and processed, changes may not be possible or may incur additional fees.

4. PRIVACY AND SECURITY

4.1 JDW Photography respects your privacy and implements reasonable security measures to protect your Gallery.

4.2 You are responsible for maintaining the confidentiality of your Gallery access credentials.

4.3 JDW Photography is not responsible for unauthorized access resulting from your failure to safeguard credentials.

4.4 Information collected through the Gallery may be used in accordance with our Privacy Policy.

5. THIRD-PARTY SERVICES

5.1 Our Gallery may be hosted through third-party services such as Pixieset.

5.2 Your use of the Gallery is also subject to any applicable terms of service of these third-party providers.

5.3 JDW Photography is not responsible for the availability, security, or privacy practices of these third-party services.

6. SERVICE LIMITATIONS

6.1 JDW Photography does not guarantee uninterrupted access to the Gallery.

6.2 The Gallery and its contents are provided "as is" without warranties of any kind.

6.3 JDW Photography reserves the right to remove, add, or modify Gallery content at any time.

6.4 Galleries may be archived or removed after a reasonable period (typically 90 days after final image delivery).

7. PROHIBITED ACTIVITIES

7.1 You agree not to:

  • Use the Gallery for any unlawful purpose

  • Attempt to gain unauthorized access to the Gallery or its systems

  • Upload harmful content or code to the Gallery

  • Engage in any activity that could damage or impair Gallery functionality

8. TERM AND TERMINATION

8.1 These Terms remain in effect for as long as you access or use the Gallery.

8.2 JDW Photography may terminate your access to the Gallery for violation of these Terms.

8.3 Upon termination, provisions relating to ownership, limitations of liability, and governing law shall survive.

9. LIMITATION OF LIABILITY

9.1 JDW Photography shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Gallery.

9.2 JDW Photography's total liability related to the Gallery shall not exceed the amount paid for your photography services.

10. GOVERNING LAW

10.1 These Terms shall be governed by the laws of the State of Tennessee.

10.2 Any disputes arising from these Terms shall be resolved in the courts of Tennessee.

11. CHANGES TO TERMS

11.1 JDW Photography reserves the right to modify these Terms at any time.

11.2 Continued use of the Gallery after changes constitutes acceptance of the revised Terms.
